This manual is prepared in terms of section 51 of the Promotion of Access to Information Act 2 of 2000 (PAIA), as amended, for Kelsper Group (Pty) Ltd (registration number 2023/530502/07), which operates Kelsper Media and Mzansi Political Safari. 3. Purpose of this manual

The purpose of this manual is to describe the records held by the private body, explain how a person may request access to records under PAIA, provide relevant contact information and set out information required by PAIA and applicable regulations.

4. Guide on using PAIA

The Information Regulator has published a guide explaining how to exercise rights under PAIA. The guide, prescribed request forms and current regulatory information are available from the Information Regulator at inforegulator.org.za. The Regulator may also be contacted through the details published on its website.

5. How to request access to a record

A person seeking access to a record that is not automatically available should submit the prescribed Form 2: Request for Access to Record to the Head of the private body, Information Officer or duly authorised Deputy Information Officer at the contact details above.

The requester must provide sufficient detail to identify the record, the requester, the form of access required and the right the requester seeks to exercise or protect, together with any other information required by PAIA. Prescribed fees may apply where permitted by law.

Access is not automatic. A request may be granted or refused in accordance with PAIA, including its provisions protecting privacy, confidential information, commercial information, safety, legal privilege and other protected interests.

6. Records that may be available without a formal PAIA request

Subject to availability and applicable law, the following categories may be publicly available without a formal PAIA request:

  • published news articles, opinion, analysis and other public editorial content on politicalsafari.co.za;
  • public editorial, corrections, privacy, ownership and other website policies;
  • public contact information;
  • public advertising or commercial information intentionally published by the organisation; and
  • other records expressly made publicly available by the private body.

This list does not mean that unpublished newsroom materials, source information, internal communications or confidential records are automatically available.

7. Records held by the private body

Depending on the operations of the entity, records may include the following categories:

  • Corporate and governance: registration, ownership, governance, policies, agreements and statutory records.
  • Financial: accounting, tax, banking, invoices, expenses, budgets and financial administration.
  • Personnel: employee, contractor, contributor, payroll and human-resources records where applicable.
  • Editorial: published content, drafts, research material, notes, source communications, recordings, images, correspondence and editorial planning.
  • Commercial: advertiser, supplier, sponsor, customer, service-provider and contractual records.
  • Technology: hosting, security, logs, domain, website, software, backup and access-control records.
  • Privacy and compliance: POPIA records, requests, consents, complaints, information-security records and regulatory correspondence.
  • Intellectual property: trademarks, copyright, licences, permissions and content-use agreements.

8. Legislation under which records may be held

Records may be kept under legislation applicable to the entity and its activities, including, where relevant:

  • Promotion of Access to Information Act 2 of 2000;
  • Protection of Personal Information Act 4 of 2013;
  • Companies Act 71 of 2008, if applicable to the legal entity;
  • Income Tax Act 58 of 1962 and Tax Administration Act 28 of 2011;
  • Value-Added Tax Act 89 of 1991, where applicable;
  • Electronic Communications and Transactions Act 25 of 2002;
  • Copyright Act 98 of 1978;
  • Consumer Protection Act 68 of 2008, where applicable;
  • Basic Conditions of Employment Act 75 of 1997, Labour Relations Act 66 of 1995, Unemployment Insurance legislation and Compensation for Occupational Injuries and Diseases Act 130 of 1993, where applicable; and
  • other legislation applicable to the organisation from time to time.

This list is not intended to be exhaustive and must be checked against the actual legal and operational position of the entity before publication.

9. Processing of personal information

Purposes of processing

Personal information may be processed to operate the organisation and website, conduct journalism, communicate with readers and sources, manage commercial and supplier relationships, comply with law, secure systems, administer personnel and maintain business records.

Categories of data subjects

  • readers and website visitors;
  • newsletter subscribers and correspondents;
  • news sources, public figures and people appearing in editorial material;
  • employees, contractors and contributors, where applicable;
  • advertisers, suppliers, service providers and business contacts; and
  • complainants, requesters and regulatory contacts.

Recipients

Information may be disclosed to authorised staff or contractors, technology and professional service providers, payment or financial service providers where relevant, public authorities when legally required, and other recipients where disclosure is lawful and necessary.

Cross-border transfers

Technology and cloud-service providers may process information outside South Africa. Where cross-border processing occurs, reasonable steps should be taken to ensure compliance with applicable legal requirements.

Security measures

The organisation uses reasonable organisational and technical safeguards appropriate to the nature of the information and the risks involved, including access controls, system security, backups and service-provider controls where appropriate.

10. Availability of this manual

A copy of this manual will be available free of charge on politicalsafari.co.za and at the principal place of business of the private body for public inspection during normal business hours, subject to applicable law. A copy may also be provided to the Information Regulator on request.

11. Complaints and remedies

A requester who is dissatisfied with the handling of a PAIA request may have rights to lodge a complaint with the Information Regulator or approach a competent court, subject to the requirements, procedures and time periods in PAIA. Current complaint forms and guidance are available from the Information Regulator.

12. Updating this manual

The Information Officer or Head of the private body is responsible for reviewing and updating this manual when organisational details, record categories, processing activities or legal requirements materially change.

Completion checklist before publication

  • Confirm whether the postal address is the same as the physical address or a different address before publishing the PAIA Manual.
  • Confirm the name and capacity of the Head of the private body. The Information Officer is Lavesh Pillay.
  • Confirm the Information Officer is registered with the Information Regulator.
  • Confirm which employment, VAT, consumer and company-law statutes actually apply.
  • Confirm the actual categories of personal information and service providers in use.
  • Check the current prescribed PAIA forms and fees before publication.
